Conditions of car rental in Tunisia:
For car rental in Tunisia with Avangarde, a series of conditions must be met. Depending on whether you are interested in renting a vehicltgardee for a short or a long term, you can opt for a passenger car or a utility vehicle. We require that the clients submit supporting documents to meet certain conditions to finalize their reservation . 1 - Definitions and general concepts:
The various concepts which refer to these conditions shall be interpreted in the light of the Recommendation of the Commission on Unfair and Abusive Clauses and Common Law (Recommendation de la Commission des clauses abusive et du droit commun) applicable to car rental contracts governed by Tunisian law, under Articles 726 and 727 of the Obligations and Contracts Code. The rental agreement is concluded ‘intuitu personae’ and cannot be assigned. "You" or «client" means drivers and payers who are listed in the contract and who signed it.
"We “stands for" the owner or service provider» that is the Avantgarde Company, whose name appears on the rental agreement. »Vehicle" means a passenger car or utility vehicle that we rent for the agreed duration of the Rental Agreement.
"Damage ": is considered damage, any damage that occurs to the vehicle such as window breaking, including optics, mirrors and headlights. » Theft " is equated with things like: vandalism, theft of accessories and attempted theft. »Tunisia" means the country where the rented vehicle can circulate. Driving our cars outside Tunisia is prohibited without express permission of Avantgarde.
2 - Conditions for renting a vehicle:
You require information and documents which are essential to the establishment of your contract including: your identity (passport), address ((home and email), your telephone number, the number, date of issue and expiry of your license and place of its issue, and the payment method of your rental. In the event of a failure to communicate the afore-mentioned data, the reservation request will not be completed. Prior to the delivery of the vehicle, another form of identification is required along with the production of an electricity or telephone bill (landline only) of less than three months confirming your name and address as you have registered at the time of your reservation and your credit card, whose number must match the one you entered when you made the reservation. These are required to take permission to cover in advance any additional supplements that are not included in your reservation and the amount shall be debited automatically on the returning of the vehicle in accordance with the provisions of Article 5.
CAUTION: Failure to submit these documents or failing to get a bank authorization prior to the delivery of the vehicle or that of non conformity with the requirements specified in the rental reservation , including , among other things, erroneous personal information in your reservation , shall prevent us from renting a vehicle and all pre prepaid prices will be forfeited to Avant-garde . Credit Cards ‘Electron, Maestro and Aurora’ are not accepted .All drivers must have held a driver's license for at least 24 months, valid and relevant to the category of vehicle rented. They must also be older than 22 years (the age requirement may be higher for certain categories of vehicles). In addition, a fee will be required for any driver aged 22 to 25 years (3 DTN TTC per day).
CAUTION : You must present the same credit card that you used in your booking on our site.
Booking cancellation conditions :
* Cancellation is free of charge before 03 days of the departure dates (except July and August) otherwise a cancellation fees may be applied
* For the two months of July & August reservations are non-refundable
Modification conditions :
* The modification of the dates is free of charge before 03 days of the departure date (except July and August)
* For the two months of July & August a modification fees may be applied
For all the bookings from March 2020, we advise you to take into account the risks associated with the coronavirus (COVID-19) as well as the measures put in place by the government. You may not be able to claim a refund. Your cancellation / modification request will be processed by the administration, depending on the conditions and circumstances
3 – The Vehicle:
3-1 – The state of the vehicle: A description of the state of the vehicle is attached to your contract. You agree to record in writing, before you leave the station, any apparent defect. Otherwise, we are deemed to have delivered a vehicle according to the description. We unfortunately cannot consider complaints regarding apparent damage that have not been reported at the time of departure. The returned vehicle must be in the state you received it. All fees of reparations resulting from a fault of the tenant, will overload the cost of the rental, subject to the provisions of the "Optional contractual waivers» section.
3-2 - Use of vehicle: You can never drive the vehicle elsewhere than in Tunisia. In accordance with the principle that penalties are personal, you are responsible for breaches or serious serious infringement committed during the rental period. Thus, you are informed that your details may be disclosed to law enforcement agents, and judicial authorities who request it. You agree to use the vehicle as a “good father” (Administration 02.26.2014 Avant-garde family) ", without being under the influence of alcohol, narcotics, or any other substance likely to affect your performance in accordance with the provisions of the Code of the Road/highway and use it for its intended purpose, which for a particular vehicle is mainly the carriage of persons for free and for a utility vehicle, mainly the carriage of goods. We particularly draw your attention to the dimensions of commercial vehicles that require increased attention for certain maneuvers (e.g.; reverse) and can make it impossible for you to use certain roads (tunnels, bridges, etc. . .), whose maximum height is governed by regulations, reported in advance
CAUTION: in case of poor appreciation of the vehicle gauge
. High shock of the body and lower body are not covered by the warranty damage except in proven cases of “force majeure.” You do not have to use the rented particular vehicle to be rented and for the transport of persons for a remuneration and for the transport of a number of passengers higher than that stated on the vehicle registration , to participate in rallies, competitions or essays, anywhere , to give driving lessons , to push or pull another vehicle (except vehicles equipped with a hook – a maximum of load 1,000 kg) on unpaved roads whose surface or state of maintenance poses risks to the tires or parts under the vehicle , and to commit an intentional offense. Goods, including baggage carried in the vehicle, including their packaging and stowage must not damage the vehicle or cause unreasonable risks to its occupants. When you park the vehicle even for a short stop, you agree to put off the vehicle engine.
4 – Duration of rental:
4-1 - Definition of the calculation: The client agrees to return the vehicle to the lessor at the date and under the contract otherwise he/she will have to face civil and criminal prosecution as well as billing late fees. An excess of 179 minutes is granted. A maximum of two (2) hours will be charged. Beyond these five hours, an entire day will be charged
ATTENTION: No fees will be returned for diminishing of the period specified in the contract
4-2 - Extension of the rent: The client should ask the company at least 48 hours in advance about the extension of the rental together with any related provision otherwise the client shall expose himself/herself to prosecution for embezzlement vehicle and breach of trust. However, the company reserves the right to itself to refuse the extension of the rent, without compensation to the client, along with the requirement for the return of the vehicle immediately.
4-3 - End of rental: rental ends with the return of the vehicle, its keys and papers at the counter of the company, to an Avant-garde agent displaying a badge. The keys shall never be handed to the people present in the parking lots and pretending to be Avant-garde agents. The client agrees to return the vehicle in a clean state internally and externally if not, he/she will be exposed to the billing of the cleaning fee (40 DTN). The cleanliness of the car will be determined during the inspection of the vehicle which will be conducted in your presence by an Avant-garde agent. The vehicle is provided with one quarter (1/4) of fuel and you must return it in the same state. If the vehicle is returned at the reserve (the LED lit gauge) a fee for service "fuel" of 20 DTN will be charged. We invite you to attend the inspection of the vehicle on its return and countersign with one of our agents the inspection report before you leave, so as to jointly spot any damage and avoid any inconvenience to both parties. However, if you decide to leave the parking lot and not wait for the inspection, you will be asked to sign the inspection form in advance, materializing your agreement to proceed with the inspection of the vehicle in your absence, and accordingly, if damage is found on your vehicle, if the vehicle is not clean, if the gauge is on reserve, if the allocated mileage is exceeded, we will proceed with the corresponding billing, pursuant to the provisions of Article 5. In the event that the vehicle is returned without its key, a lump sum of 150 DTN will be charged and, where appropriate, we charge the costs when returning the vehicle in accordance with the provisions of Article 5. The owner cannot in any way be held responsible for goods that have been left in the vehicle at the end of the lease.
CAUTION: Only the takings up of the vehicle, its documents, and keys by the agent, at the opening hours of the agency, permit the termination of the rental. Reminder: your liabilities remain full until the end of the contract. Exceptions: in case of forfeiture or sealing of the vehicle, the lease may be terminated automatically when the owner will be informed by the judicial authorities or the client. Any use of the vehicle that would prejudice the owner allows the latter to automatically terminate the contract. In case of theft, the rent shall end upon delivery to the company of the complaint made by the client to the competent authorities. In case of accident, the contract shall end upon delivery to the company of an accident report completed by the client and the concerned third parties.
5 - Definitions and general concepts:
5-1 - The price, subject to an early partial payment, cannot be subject to sale price or be combined with any other promotional offer. The booking confirmation with advance payment is not transferable. The price includes the contractual guarantee for any damage caused to the vehicle subject to a non -waivable amount. (See the Table of irredeemable franchises CDW). The price paid by anticipation excludes any additional costs that are not specifically mentioned as included in the booking confirmation in advance and any additional optional services which the customer must pay. The same valid credit card must be submitted to the Avant-garde counter to pick up the vehicle, and its number must match the one you specified when booking. Credit cards ‘Maestro, Electron and Aurora ‘are not accepted. The client agrees already on the debit of the account corresponding to the credit card used of a non -waivable amount (see table at end of document) and all other fees, including those for damage (s) or theft of the rented vehicle. Clients are liable for the full cost of the rental. The lessee expressly agrees that the failure to pay one invoice when due or unpaid authorizes the lesser to require the immediate return of the vehicle during the rental
5-2 - The rental price: The rental price is per 24-hour period and includes a package unless otherwise expressly stated mileage on the contract. Exceeding this package, the customer will pay a penalty of 500 Millimes for each additional kilometer. Any attempted tampering meter mileage of the vehicle or one of its accessory parts will be subject to a prosecution
5-3 - Guarantee Deposit: The amount of the deposit depends on the one hand, on the category of the leased vehicle and on additional safeguards included in your fare, on the other hand. This deposit is a sum paid in advance on the compensation of the damage occasioned to the company. The client is automatically covered when choosing a tariff including contractual guarantees given on the contract damages, a deposit equal to the amount of the non –waivable amount to be borne by the renter in case of damage or theft. The deposit will be forfeited to the company for any damage caused to the client and if the vehicle is stolen. In the absence of damage and / or theft, and assuming that no supplement is needed to return the vehicle, then the amount of the deposit actually paid will be refunded at end of rental.
5-4 - Conversion of payment: When the client makes a payment with a credit card whose home currency is other than the Tunisian Dinar, he/she can pay the rent in Tunisian Dinar or in the above-mentioned currency. This choice can be changed by the client on returning the vehicle provided that he/she makes asks immediately for the establishment of an invoice. Otherwise, the choice made in the beginning of the rental will be considered final. If the client opts for payment in the original currency of the card, the amount charged (VAT) for the rental will be converted after the invoicing on the basis of aggregate exchange rate of the day determined by the inter-banking cards network, plus a 3% commission. If for any reason whatsoever, the conversion cannot be performed by the Lessor; the transaction shall be effected in the currency of the country of rental.
5-5 - minimum number of rental days: - High season (June / July / August) = 03 days - Low season = 02 days
6 - Liability:
For any damage caused to the vehicle or theft, you are accountable for the vehicle under your care.
Thus, in case of theft or damage caused to it by your fault or by fault of a third party, you will indemnify the owner for the damage actually occasioned ( cost of repairs , market value of the vehicle , capital costs , fees ... ) . At the end of the rental, in case of damage or theft, an amount equivalent to that of the non -waivable one will be charged (see section 7-1). If the amount of damage suffered by the company exceeds the said non-waivable amount, a different invoice will be established. If the prejudice occasioned to the company should be reduced (vehicle discovered within 60 days, sharing or total responsibility of a third party...), the client would be reimbursed in accordance with the reduction. This liability is limited by guarantee in case of damage and / or theft outlined in Article 7 as "diminished responsibility."
7 - Our contractual guarantees:
7-1 – Guarantee (CDW) damage or theft (TP00): For the contractual guarantee in case of theft, as for the subscription of one of our contractual guarantees in the event of damage to your vehicle, your liability is limited to the amount of the non -waivable amount fixed, and you will be charged per claim for damage or theft. The amounts of non-redeemable franchises (FNR) and (TTC) of these guarantees are calculated on the basis of Contractual warranty for damage CDW: the amount (FNR) all taxes included (TTC) varies depending on the vehicle category (see Table of guarantee for damage CDW). The additional cost per day of the contractual warranty amounts to 15 DTN (TTC) (contractual warranty in case of theft TP: the amount (FNR) TTC varies depending on the vehicle category (see table of guarantees in case of theft TP). The additional cost per day of the contractual warranty amounts to 15 DTN TTC. The purchase of one of these two contractual guarantees in case of damage is compulsory for drivers aged 22-25 years. If the actual amount of damages occasioned by an accident caused by the lessor is less than this amount, only the lesser of two amounts will be charged if your liability is completely cleared, and when from the reimbursement obtained from third parties responsible for the accident, the amount will be fully restored.
7-2 - Revocation of the guarantee: Drivers not specified in the Rental Agreement, and that the renter remains responsible for, cannot claim the benefit of guarantees on Damage and Theft Protection. These guarantees are valid in Tunisia during the term of the rental. Disrespect of any of the obligations expressly set forth in articles 2, 3-2, 4-2 of these Terms will result in forfeiture of contractual guarantees. The renters will be responsible for the entire loss in terms of the common law of torts
